MomentScience End User Privacy Policy
MomentScience (MomentScience,” “us,” “our,” or “we”) is a transaction marketing
company. We provide services to partners (“Partners”) that allow
individuals to receive offers, contests, promotions, coupons, discounts,
app download invitations, calendar subscription invitations, surveys/poll
invitations, and invitations to enter sweepstakes and interact with other
marketing services (including during or after a transaction)
(collectively, “Offers”) from third-party advertisers (“Advertisers”)
displayed on MomentScience.com and other MomentScience websites (“MomentScience Owned
Sites”) and MomentScience technology that is integrated on our Partners’
websites, app or mobile-device applications (“Partner Sites”)
(collectively, the “MomentScience Sites”).
MomentScience values the
privacy of individuals viewing or otherwise engaging with Offers on
MomentScience Sites (“Users,” “you,” or “your”). This privacy policy (the
“Privacy Policy”) explains how MomentScience collects and uses information from
Users to facilitate the protection of Users and to continue to improve the
MomentScience Sites. Beyond the Privacy Policy, your use of the MomentScience Owned
Sites is also subject to our Terms of Service.
Information We Collect
We may collect a variety of information from or about you or your devices
from various sources, as described below.
A. Information You Provide to Us.
Offers. When you engage with, or sign
up for Offers across MomentScience Sites, you may provide us with information
about you in connection with the Offer, such as your name, email address,
telephone number, age, and location.
Communications.
If you contact us directly, we may receive additional information about
you. For example, when you contact our customer support team, we will
receive your name, email address, phone number, the contents of a message
or attachments that you may send to us, and other information you choose
to provide.
B. Information We Collect Automatically.
Location Information. We
may infer your general location information, for example by using your
internet protocol (IP) address.
Device Information.
We receive information about the device and software you use to access our
Services, including IP address, web browser type, operating system
version, phone carrier and manufacturer, application installations, device
identifiers, mobile advertising identifiers, and push notification tokens.
Usage Information. We receive
usage data about your interaction with Offers, or any communications sent
on behalf of MomentScience, Advertisers or Partners, including information
relating to your Offer interaction, such as Offer click-through rates and
viewing data.
Information from Cookies and Similar Technologies.
We and our third-party partners collect information using cookies, pixel
tags, or similar technologies. Our third-party partners, such as analytics
and advertising partners, may use these technologies to collect
information about your online activities over time and across different
services. Cookies are small text files containing a string of alphanumeric
characters. We may use both session cookies and persistent cookies. A
session cookie disappears after you close your browser. A persistent
cookie remains after you close your browser and may be used by your
browser on subsequent visits to our Services.
Please review
your web browser’s “Help” file to learn the proper way to modify your
cookie settings. Please note that if you delete or choose not to accept
cookies from the Service, you may not be able to utilize the features of
the Service to their fullest potential.
Widgets.
When you visit an MomentScience Site with our widget embedded, we may
receive certain information, including information about the web page you
visited, your IP address, and other information about your device. The
widget can recognize you across websites containing widgets, and the
widget may be used to show personalized content or advertising. We know
when you interact with a widget, and websites containing the widgets may
receive this information.
C. Information We Receive from Third Parties.
Advertisers and Partners.
We may receive information about you from Advertisers and Partners (as
part of our services to them), such as your identifying details, such as
email address, gender, age, postcode, title, phone number, transaction
details or conversion data (such as what you purchased, when and via what
method).
Other Third Parties.
We may receive additional information about you from third parties, such
as data or marketing partners, and combine it with other information we
have about you.. We may obtain information about you from third-party
sources and platforms (including data validation services, authentication
service providers (including for calendaring services), data enrichment
providers, social networking sites, online marketing and segmentation
providers, and ad-targeting companies) to supplement the information we
collect from Partners and Advertisers and directly from you. For example,
when you sign up to a sweepstakes competition or drawing an Offer using
your email address, we verify with a validation service that the email
address is real, in order to ensure valid registration information and
prevent fraudulent signups. In other cases, we may use age verification
providers in order to ensure that offers are appropriate for a particular
individual above or below the age of majority, or the age of digital
consent.
How We Use the Information We Collect
We use the information we collect:
- To provide, maintain, improve, and enhance our Services;
- To personalize your experience on our Services such as by providing tailored content and recommendations;
- To understand and analyze how you use our Services and develop new products, services, features, and functionality;
- To communicate with you, provide you with updates and other information
relating to our Services, provide information that you request, respond
to comments and questions, and otherwise provide customer support;
- To facilitate the connection of third-party services or applications;
- To administer MomentScience-sponsored sweepstakes, competitions or drawings you enter ;
- For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable, or otherwise of interest to you;
- To share with Partners and Advertisers in connection with the Offers;
- To generate anonymized, aggregate data containing only de-identified, non-personal information that we may use to publish reports and provide safety updates;
- To send you text messages and push notifications;
- To facilitate transactions and payments;
- To find and prevent fraud, and respond to trust and safety issues that may arise;
- For compliance purposes, including enforcing our Terms of Service or exercising or enforcing other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
- For other purposes for which we provide specific notice at the time the information is collected.
How We Share the Information We Collect
Affiliates. We may share any information
we receive with our affiliates for any of the purposes described in this
Privacy Policy.
Vendors and Service Providers.
We may share any information we receive with vendors and service providers
retained in connection with the provision of our services.
Marketing. We do not rent, sell, or
share information about you with nonaffiliated companies for their direct
marketing purposes, unless we have your permission.
Advertisers and Partners.
We work with Advertisers and Partners to show you Offers that we think may
interest you. Some of our Advertisers and Partners may be members of the
Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info). If you do not wish to receive personalized ads, please visit their
opt-out pages to learn about how you may opt out of receiving web-based
personalized ads from member companies. You can access any settings
offered by your mobile operating system to limit ad tracking, or you can
install the AppChoices mobile app to learn more about how you may opt out
of personalized ads in mobile apps.
As Required by Law and Similar Disclosures.
We may access, preserve, and disclose your information if we believe doing
so is required or appropriate to: (a) comply with law enforcement requests
and legal process, such as a court order or subpoena; (b) respond to your
requests; or (c) protect your, our, or others’ rights, property, or safety
Merger, Sale, or Other Asset Transfers.
We may transfer your information to service providers, advisors, potential
transactional partners, or other third parties in connection with the
consideration, negotiation, or completion of a corporate transaction in
which we are acquired by or merged with another company or we sell,
liquidate, or transfer all or a portion of our assets.
Consent.
We may also disclose your information with your permission.
Your Choices
Opting Out of Our Marketing Communications.
You can unsubscribe from promotional emails from MomentScience via the link
provided in the emails. Even if you opt out of receiving promotional
messages from us, you will continue to receive administrative messages
from us.
Opting Out of Advertiser Offers.
MomentScience provides a facility for you to opt out of seeing all future
third-party Advertisers Offers on MomentScience Sites (thereby avoiding any
targeted third-party offers in future). To request this, please send an
email to privacy@MomentScience.com with the subject “Opt Out”. Note we will
keep a copy of your email address on file to retain a record that you have
opted out. If you use another email with MomentScience Partners, then you may
need to opt out from multiple email addresses in order to ensure you don’t
see any targeted third-party offers in future. Even if you opt out you
will still need to unsubscribe directly from any Partner or Advertiser’s
mailing list if you want to stop receiving electronic communications from
them.
Opting Out of Partner Offers.
Even if you opt out of Advertiser Offers, you will still see offers from
Partners which are native to the Partner’s site. Please consult the
privacy policies or notice of those Partners to understand your choices
with respect to those offers.
What this Privacy Policy Does Not Cover
This Privacy Policy does not apply where MomentScience processes your
information on behalf of any Partners to enable those Partners to serve
their own Offers and not those of any other Advertiser. Please consult the
privacy policies or notices of those Partners to understand how they use
your information.
Where MomentScience provides information to a
third-party (such as an Advertiser or Partner) (for example in relation to
an Offer), you acknowledge that your information will be handled by that
third-party in accordance with its own privacy policy and not in
accordance with the MomentScience privacy policy. You should consult our
Advertiser’s and Partner’s own privacy policies for further details on
their use, disclosure, transmission or storage of your information.
This policy does not apply to the practices of organizations that
MomentScience does not own or control, or to people that MomentScience does not
employ or oversee even if offers, coupons or links to their websites
appear within our technology.
As a marketing technology
provider, MomentScience does not endorse any specific Partner or Advertisers,
nor does it take any responsibility for concluding or finalizing Offers on
their behalf. MomentScience gives you the opportunity to elect to receive
information about Offers that you determine are of interest to you –
without taking any of your specific personal circumstances into account.
International Visitors
Our Services are hosted in the United States (“U.S.”) and intended for
visitors located within the U.S. If you choose to use our Services from
the European Union or other regions of the world with laws governing data
collection and use that may differ from U.S. law, then please note that
you are transferring your information outside of those regions to the U.S.
for storage and processing. We may transfer information from the European
Economic Area, Switzerland, or the United Kingdom to the U.S. and other
countries based on standard contractual clauses approved in the applicable
jurisdiction, or otherwise in accordance with applicable data protection
laws. Also, we may transfer your data from the U.S. to other countries or
regions in connection with storage and processing of data, fulfilling your
requests, and operating our Services. By providing any information,
including information, on or to the AdPostX Sites, you consent to such
transfer, storage, and processing.
Disclosure of your Personal Information across International
recipients MomentScience processes Personal Information across multiple countries, on
high-security servers, possibly located outside the country where you
live, with our primary servers located in the USA. Before we disclose your
Personal Information to an overseas recipient, we take steps as are
necessary and reasonable in the circumstances to ensure that the overseas
recipient does not breach privacy laws in relation to your Personal
Information.Where we disclose your Personal Information to Advertisers and
other third-party processors, it is likely (although not assured) the
Advertisers or third-party processor will be located in one of the markets
in which we operate or have a presence – namely the United States, India,
Canada, Mexico, Argentina and the United Kingdom.MomentScience discloses
Personal Information of individuals located in the European Economic Area
with: (i) suppliers; (ii) other members of MomentScience, Inc.; and (iii)
MomentScience’s Advertisers and Partners located outside of the European
Economic Area. Such transfers may be made: (a) to a third country or
territory that is assessed by the European Commission as ensuring an
adequate level of protection; (b) to recipients who have in place
appropriate safeguards, such as standard contractual clauses that are
approved by the European Commission or binding corporate rules that have
been approved by a competent supervisory authority; or (c) where a
transfer to a third country is occasional and necessary in relation to a
contract between us or in your interest or for the establishment, exercise
or defense of legal claims. In order to safeguard transfers of personal
data for EU residents outside of the EU, MomentScience discloses information
concerning EU residents both (i) with suppliers and (ii) with Advertisers,
on the basis of EU-approved standard contractual clauses approved under
Art 47 GDPR. For more on how we handle GDPR.
Security
We make reasonable efforts to protect your information by using physical
and electronic safeguards designed to improve the security of the
information we maintain. However, as no electronic transmission or storage
of information can be entirely secure, we can make no guarantees as to the
security or privacy of your information.
Children’s Privacy
MomentScience does not allow advertisements to be targeted at individuals under
the age of 16, and we do not knowingly collect, maintain, or use personal
information from children under 13 years of age, and no part of Services
directed to children. If you learn that a child has provided us with
personal information in violation of this Privacy Policy, then please
contact us at the email address provided below in the “Contact
Information” section. If we learn that we have collected Personal
Information on a child under the age of 13, we will delete that data from
our systems.
Changes to this Privacy Policy
We will post any adjustments to the Privacy Policy on this page, and the
revised version will be effective when it is posted. If we materially
change the ways in which we use or share personal information previously
collected from you through the Services, we will notify you through the
